Yours Clothing, Bad Rhino, Long Tall Sally, Pixie Girl and Bump It Up Maternity reserves the right to alter these Terms of Use without advance notice by posting a revised Terms of Use. Accordingly, you should review the Terms of Use each time you access the Yours Clothing website available at yoursclothing.com (the “Site”), the Bad Rhino website available at badrhino.com (the “Site”), the Long Tall Sally website available at longtallsally.com (the "Site"), and the Pixie Girl website available at pixiegirl.com (the "Site") to stay informed of any changes to the Terms of Use. Any access or use of the Site or by you after such notice shall be deemed to constitute acceptance by you of such changes, modifications or additions.
1. Use of the services
These TOU apply to all of the Yours Clothing, Bad Rhino and Bump It Up Site, unless otherwise provided.
Yours Clothing, Bad Rhino and Bump It Up Maternity facilitates the direct upload of user photos, text, graphics, audio, video, location information and comments (“User Content” or “User Generated Content”) to their websites and other digital properties, for use by the Brand in marketing, promotional, advertising and other customer engagement channels, as well as the collection of User Content from social media sites
2. User content
By accepting these TOU, you grant Yours Clothing, Bad Rhino, Long Tall Sally, Pixie Girl and Bump It Up Maternity the worldwide, perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable right to use your User Content in any manner to be determined in Yours Clothing, Bad Rhino, Long Tall Sally, Pixie Girl and Bump It Up Maternity’s sole discretion, including but not limited to on its webpages, social media pages operated by Yours Clothing, Bad Rhino, Long Tall Sally, Pixie Girl and Bump It Up Maternity’s, promotional e-mails and advertisements, and in other marketing, promotional and advertising initiatives, in any media now or hereafter known. Yours Clothing, Bad Rhino, Long Tall Sally, Pixie Girl and Bump It Up Maternity may use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, alter and/or edit your User Content in any manner in their sole discretion, with no obligation to you whatsoever. You grant Yours Clothing, Bad Rhino and Bump It Up Maternity the right to use your username, real name, image, likeness, caption, location or other identifying information in connection with any use of your User Content.
You hereby represent and warrant that (i) you own all rights in and to your User Content, or, if the User Content is subject to third party proprietary rights, including, for example, material protected by copyright, trademark, patent or trade secret law or other proprietary rights laws, you have all necessary licenses, rights, consents, and permissions to publish the User Content you submit and to grant the rights granted herein, including permission from all person(s) appearing in your User Content; (ii) you are not a minor, (iii) you are legally entitled to post the User Content, and (iv) the User Content is not libellous, defamatory, obscene, pornographic, abusive, indecent, threatening, harassing, hateful, or offensive and Yours Clothing, Bad Rhino, Long Tall Sally, Pixie Girl and Bump It Up Maternity use of your User Content as described herein will not violate any other law. You hereby release, discharge and agree to hold Yours Clothing, Bad Rhino, Long Tall Sally, Pixie Girl and Bump It Up Maternity, and any person acting on their behalf, harmless from any liability related in any way to Yours Clothing, Bad Rhino, Long Tall Sally, Pixie Girl and Bump It Up Maternity’s use of your User Content.
Yours Clothing, Bad Rhino, Long Tall Sally, Pixie Girl and Bump It Up Maternity reserve the right to remove any User Content from the Site, the Brand properties and the Services at any time, for any reason.
3. Personal information we collect
We collect information from Social Media Users such as public uploads and posts, including publicly posted photographs. With such assets, we process name, social media username, physical address (if available), email-address (if available), IP address, and geo location (if available).
4. Use of personal information
Social Media Users: We only process Personal Information we collect from you through brand hashtags, @brand mentions or branded location tags you have included in your social media posts. We may use your username or email address to communicate with you, in addition to using your photo. IP and geo-location are used to filter content by region, country or other local area. Such data is used with your consent only.
5. Win a new spring wardrobe
1. The promoter of this prize draw is Yours Clothing (Company no. 02886196) whose registered office is at Newcombe House, Bakewell Road, Orton Southgate, Peterborough, PE2 6XU. 2. The competition is open to our followers who live within the UK. [With the exception of employees of the promoter, their families, agents, and anyone else connected with this promotion.] 3. To enter this prize draw you must make sure you are following the @yoursclothing Instagram account, tag your friends in the comments of the competition post and like the post. There is also the option for a bonus entry, and you need to share the post to your Instagram story to be eligible for this. 4. By entering this prize draw you are indicating your agreement to be bound by these terms and conditions. 5. No entrant may win more than one prize and there will be 1 winner announced. 6. Entries must be received by Friday 24th March at 6:00pm. The promoter accepts no responsibility for entries that are incomplete, illegible, corrupted, or fails to reach the promoter by the closing date for any reason. 7. All correctly completed entries will be entered into the draw which will take place on Friday 23rd March 2023. 8. The promoter reserves the right to cancel or amend the prize draw and these terms and conditions without notice in the event of an anticipated breach of any law or regulation, or any other event outside of the promoter’s control. Any changes to the prize draw will be notified to entrants as soon as possible by the promoter. 9. The promoter is not responsible for any inaccurate details supplied to an entrant by any third party connected with this prize draw. 10. The prize is a £250 voucher. 11. The prize is as stated, and no alternative will be offered. The prize is not transferable. All prizes are subject to availability, and we reserve the right to substitute any prize with another of equivalent value without giving notice. 12. There will be 1 winner chosen from all entries verified and entered in the draw by the promoter. 13. The winners will be notified via direct message on Instagram by Friday 23rd March. The winner must claim their prize within 30 working days, or the promoter reserves the right to offer the prize to a substitute winner. 14. The winners will only be contacted via the official @yoursclothing Instagram account. 15. The promoter will only use data submitted by entrants for the purpose of running the prize draw, unless otherwise stated in the entry details. By entering this competition, you consent to the use of your data for administration of this promotion. You are providing your information to Long Tall Sally Limited and not to any other party. This information will be used in conjunction with the following Privacy Policy found at https://www.yoursclothing.com/privacy-policy 16. This promotion is not sponsored, endorsed, or administered by, or associated with any other third party associated with hosting or promoting this prize draw. They shall not be liable with regards to this promotion. 17. The winner’s name will be available for 28 days after the closing date by emailing the following address [email protected]. The names of winners from previous draws will also be available for 28 days. 18. The promoter may disqualify any entrant whose entry does not comply with these terms and conditions (in the promoter’s sole opinion) or who, in the promoter’s sole determination, has acted in a manner that is fraudulent, dishonest, or unjust to other entrants including, without limitation, tampering with the operation of the prize draw, manipulating, hacking, deceiving, cheating or by harassing or threatening other entrants or a representative of promoter. 19. These terms and conditions are governed in accordance with the laws of England and Wales.
